By accessing or using the MetabolicOS application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Free Tier (MetabolicOS Core): Health tracking, food logging, barcode scanning, saved meals, data export/import, and basic daily planning tools.
Pro Tier (MetabolicOS Pro): Predictive analytics, adaptive targets, batch meal prep engine, advanced micronutrient tracking, cloud sync, and AI-powered label reading. $49.99/year.
Elite Tier (MetabolicOS Elite): AI daily coaching, lab result interpretation, medication interaction tracking, sleep correlation, provider export, and family sharing. $99.99/year.

4.2 Not Medical Advice

IMPORTANT: MetabolicOS is a health tracking and informational tool. It is NOT a medical device, and the Service does NOT provide medical advice, diagnosis, or treatment. All predictions, correlations, insights, and coaching suggestions are for informational and educational purposes only. Always consult a qualified healthcare provider before making decisions about your health, medications, diet, or exercise program.

5. Subscriptions and Payments

5.1 Free Tier

The MetabolicOS Core free tier is available at no cost and will remain free. We will never paywall basic tracking features including food logging, barcode scanning, blood pressure logging, weight tracking, water tracking, lab result entry, saved meals, data export/import, or the daily checklist.

5.2 Paid Subscriptions

Pro and Elite subscriptions are billed annually. By subscribing, you authorize us to charge your selected payment method on a recurring basis until you cancel.

5.3 Free Trials

We may offer free trial periods for paid tiers. If you do not cancel before the trial expires, your payment method will be charged. We will send a reminder before the trial period ends.

5.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

You retain access to paid features through the end of your billing period
Your account reverts to the free tier after the billing period ends
All your tracked data remains accessible regardless of tier
Refunds may be issued on a case-by-case basis within 14 days of purchase

5.5 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price increases will not apply to your current billing cycle.

6. User Data and Content

6.1 Your Data

You retain full ownership of all health data, food logs, lab results, and other personal information you enter into MetabolicOS. We do not claim any ownership rights over your data.

6.2 License to Operate

By using the Service, you grant us a limited, non-exclusive license to process, store, and display your data solely for the purpose of providing and improving the Service. This license terminates when you delete your data or account.

6.3 Data Portability

You may export all of your data at any time using the built-in export feature. We will never restrict your ability to export your own data, regardless of subscription tier.

6.4 Data Deletion

You may request deletion of your account and all associated data at any time. We will delete your data within 30 days, except where retention is required by law.

7. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or disassemble the Service
Interfere with or disrupt the Service or its servers and networks
Attempt to gain unauthorized access to any part of the Service
Use automated scripts, bots, or scrapers to access the Service
Upload malicious code, viruses, or harmful data
Impersonate any person or entity
Collect data about other users without consent
Resell, sublicense, or commercially exploit the Service without written permission
Circumvent any access controls or usage limits

8. Intellectual Property

The Service, including its design, software, algorithms, text, graphics, logos, and all other content created by us, is owned by the Company and protected by intellectual property laws. Third-party content (such as Open Food Facts data) is subject to its own licensing terms.

If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use that feedback without obligation to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, or that nutritional data, predictions, or health insights will be accurate or complete.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.00.

12. Dispute Resolution

12.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18. General Provisions

These Terms and our Privacy Policy constitute the entire agreement between you and the Company. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not constitute a waiver.
